By using this website, requesting a quote, submitting a form, creating an account, purchasing or inquiring about insurance, or opting into our SMS program, you agree to these Terms.

1. Who We Are

These Terms are provided by Ruly Insurance LLC, doing business as Ruly Insurance Brokerage (“we,” “us,” or “our”), an insurance agency. We offer insurance products and related services in Kansas, Missouri, Nebraska, and Texas.

We are an independent insurance agency. We are not an insurance company. Coverage, if issued, is provided by the insurance carrier named in your policy, quote, or binder, subject to that carrier’s underwriting guidelines and the policy terms.

2. Eligibility

  • You must be at least 18 years of age to use this website, request insurance services, or enroll in our SMS program.

  • You must be legally able to enter a contract.

  • Insurance products are available only where we are licensed and only where the product may lawfully be offered. Availability varies by state, property location, and carrier.

  • By using this site or submitting information, you represent that the information you provide is true, accurate, and complete.

3. Insurance Services

  • We may help you obtain quotes, compare options, submit applications, and service policies for products such as rental, landlord, property, and other insurance we are authorized to offer.

  • A quote is an estimate only. It is not a binder, policy, or guarantee of coverage, price, or eligibility.

  • Coverage begins only if a carrier accepts the risk and issues a binder or policy, and only according to the terms of that binder or policy.

  • Premiums, deductibles, limits, exclusions, and availability can change. Carriers may decline, cancel, or nonrenew coverage as permitted by the policy and applicable law.

4. Quotes, Applications, and Your Responsibilities

  • You must provide complete and accurate information. Incomplete or incorrect information can delay a quote, change the premium, or result in denial, cancellation, or a claim denial.

  • You authorize us to share information you submit with insurance carriers, managing general agents, wholesalers, inspection companies, payment processors, and other parties as needed to quote, underwrite, bind, issue, or service insurance.

  • Payment of premium does not by itself create coverage unless a carrier has agreed to bind or issue the policy.

  • You are responsible for paying premium on time to keep coverage in force, subject to the policy and applicable law.

  • We may record or keep copies of applications, communications, and transaction records as needed to provide services and meet legal and regulatory requirements.

5. Website Use and Accounts

  • You may use this website only for lawful purposes and only to inquire about or manage insurance and related communications with us.

  • If you create an account, you are responsible for keeping your login credentials confidential and for activity under your account.

  • We may change, suspend, or discontinue any part of the website at any time.

7. SMS Terms and Conditions

This section applies if you opt into our text messaging program.

  • Program. Ruly Insurance LLC, dba Ruly Insurance Brokerage operates an SMS program. If you opt in, we may send you messages about our insurance services, account or policy updates, service notifications, document or appointment reminders, and promotional offers related to our services.

  • Opt-In. You opt in by providing your mobile number and consenting through a website form, keyword, checkout or quote flow, or another clear opt-in method we provide. By subscribing, you consent to receive SMS messages at the phone number you provided. You represent that you are the subscriber or customary user of that number, or that you have authority to enroll it.

  • Age. You must be 18 years of age or older to enroll in the SMS program.

  • Frequency. Message frequency varies.

  • Rates. Message and data rates may apply. For questions about your text or data plan, contact your wireless provider.

  • Opt-Out. Text STOP to opt out. After you send STOP, we will send a confirmation message, and you will no longer receive SMS messages from this program. To rejoin later, you must opt in again. Opting out of SMS does not cancel insurance coverage, stop legally required notices, or end other communications we may send by email, mail, or phone when permitted.

  • Consent not required to purchase. Consent to receive text messages is not required as a condition of purchasing insurance or using our services.

  • Supported carriers. The program should work with major U.S. wireless carriers, but we do not guarantee delivery on every carrier or device.

  • Carrier Liability. Carriers are not liable for delayed or undelivered messages.

  • Privacy. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Our SMS vendor and other service providers may process mobile numbers only to deliver messages and operate the program. Text messaging originator opt-in data and consent will not be shared with any third parties except as needed to provide the messaging service or as required by law.   • Your number. You must notify us promptly if you change or give up the mobile number you enrolled.

8. Electronic Communications

By using this website or providing your email address or mobile number, you agree that we may communicate with you electronically about your requests, account, policy service, and these Terms. Electronic notices may be provided by email, SMS if you opted in, or by posting to the website. You are responsible for keeping your contact information current.

9. Intellectual Property

THE WEBSITE, QUOTES, CONTENT, AND SMS PROGRAM ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

  • A quote will match the final premium or that coverage will be offered or bound.

  • Website content is complete, current, or free of errors.

  • SMS or email messages will be delivered without delay or interruption.

Nothing on this website changes the terms of an insurance policy issued by a carrier.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF YOUR USE OF THE WEBSITE, OUR SERVICES, OR THE SMS PROGRAM.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS, THE WEBSITE, OR THE SMS PROGRAM WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID US, IF ANY, FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

This limitation does not limit liability that cannot be limited under applicable law, including liability arising from our own fraud or willful misconduct, or any duty that insurance licensing law does not allow us to disclaim.

Insurance coverage disputes are governed by the applicable policy and by law. The issuing carrier, not this website, is responsible for paying covered claims according to the policy.

14. Indemnification

You agree to defend, indemnify, and hold harmless Ruly Insurance LLC, dba Ruly Insurance Brokerage, its owners, employees, and agents from claims, damages, losses, and reasonable expenses (including attorneys’ fees) arising out of:

  • Your use of the website or SMS program.

  • Your breach of these Terms.

  • Inaccurate or incomplete information you provide.

  • Your violation of law or of a third party’s rights.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law rules, except that insurance coverage and agency licensing issues are also subject to the insurance laws of the state where the product is offered or the property is located.

You agree that courts located in Platte County, Missouri will have exclusive jurisdiction over disputes arising out of these Terms or your use of the website, except where applicable insurance or consumer law requires another venue.

If you have a concern, please contact us first so we can try to resolve it.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above. If we make material changes, we may also provide additional notice, such as a website posting or email. 17. Miscellaneous

  • If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
